Terms of Use
Welcome, and thank you for using Split The Distance ("we," "our," or "us") and our website at splitthedistance.com, including all related services, features, and applications (collectively, the "Service"). These Terms of Use ("Terms") are a legally binding agreement between you and Split The Distance governing your use of the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Service Overview
Split The Distance is a web application that helps users find a fair meeting point between two or more locations based on actual drive, bike, or walk time. The Service uses third-party mapping, geocoding, and place-search APIs to calculate midpoints and display nearby places of interest such as restaurants, cafes, and parks.
2. Eligibility
You must be at least 13 years old to use the Service. By agreeing to these Terms you represent that: (a) you are at least 13 years old; (b) you have not previously been suspended or removed from the Service; and (c) your use of the Service complies with all applicable laws and regulations.
3. Accounts & Registration
Certain features of the Service require you to create an account. You may register using your Google or Apple account via our authentication provider, Supabase. When you register, you agree to provide accurate information and to keep it current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Free & Paid Features
The Service offers both free and paid features. Free features may be used without a subscription. Premium features require an active paid subscription.
4.1 Pricing
Current pricing is published on our website. We reserve the right to change pricing at any time; if we do, we will provide advance notice before the change takes effect. All prices are in U.S. dollars unless otherwise stated.
4.2 Subscriptions & Billing
Paid subscriptions automatically renew at the end of each billing period (monthly or yearly) until cancelled. You authorize us and our payment processor, Stripe, to charge the payment method on file for all recurring subscription fees and applicable taxes. You must cancel before the renewal date to avoid being charged for the next period.
4.3 Refunds
Subscription fees are generally non-refundable except as required by applicable law. If you believe you were charged in error, contact us and we will review your request.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any law.
- Interfere with or disrupt the Service, its servers, or connected networks.
- Attempt to gain unauthorized access to any part of the Service or its systems.
- Scrape, crawl, or use automated means to access the Service without our prior written consent.
- Reverse-engineer, decompile, or disassemble any portion of the Service.
- Impersonate any person or entity, or misrepresent your affiliation.
- Transmit viruses, malware, or any other harmful code.
- Use the Service to harass, threaten, or harm any person.
6. Intellectual Property
The Service, including its design, code, graphics, and content (collectively, "Materials"), is owned by Split The Distance and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Materials except as expressly permitted by these Terms.
7. Third-Party Services
The Service integrates with third-party services including Google Maps, Mapbox, Supabase, and Stripe. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. Route calculations, midpoint locations, and place information are approximate and should not be relied upon as the sole basis for travel decisions.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SPLIT THE DISTANCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you paid us in the 12 months before the event giving rise to the claim; or (b) $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless Split The Distance and its affiliates from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Sections 6, 8, 9, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in New York.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" above. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
